Terms of use

These terms describe the rules for using Atelier, the browser-based 3D design service published by MAXKEN, and the responsibilities of each party.

1. Service and scope

Atelier, available at ateliercad.com, is published by MAXKEN, a French limited liability company registered under number 821 612 611 RCS Lille Métropole, with its registered office at Bureau 3, 34 place du Général de Gaulle, 59800 Lille, France. Its full details are available in the legal notice.

The service provides sketching, parametric modeling, assembly, import and export tools, local saving and, when available, account-based online saving and collaboration. Available features and limits are described in the interface and documentation. Atelier is currently offered as a beta.

These terms concern use of the service. Local use is free, including for commercial projects. The cloud subscriptions shown on the pricing page are announced as coming soon and will require specific terms before subscription. Simply visiting or using the editor does not place a paid order or create a paid subscription. You remain responsible for your equipment and internet access costs.

Publisher details

2. Access and accounts

The local editor can be used without an account. Online saving and collaboration require an account and the availability of those services. Use a compatible, up-to-date browser and hardware suited to 3D rendering. Opening the application and using online features require an internet connection; offline features depend on files already available on your device.

Provide accurate account information, keep your sign-in credentials confidential and notify MAXKEN if you suspect unauthorized access. You must be legally able to use the service; where necessary, a minor must have authorization from their legal representative. If you act for an organization, you must have authority to do so.

3. Projects, saving and quotas

Local projects are stored in the browser on your device. Clearing site data, using private browsing, changing devices or a browser storage eviction can make them unavailable. Save regular independent copies, particularly an Atelier project archive when you want to preserve its editable history.

Online saving is separate from local saving. Check the saving status before leaving a project or switching devices. Storage quotas, project and file-size limits, and request limits can apply. When a quota is reached, older project revisions can be removed to make room; if saving fails, recent work may remain only on the device.

Collaboration conflicts can require you to choose a version or keep a recovery copy; changes are not automatically merged. Local saving, online versions and service backups serve different purposes and do not replace your own independent copies.

Features and technical limits

4. Sharing and collaboration

The project owner controls invitations and member permissions. Share invitation links only with the intended recipients: a person holding a valid link can use the access it grants. Members can view, comment, edit or export according to the permissions available to them.

Before sharing a project, check that you have permission to disclose its contents, including any confidential information or personal data. Removing a member or revoking an invitation limits further access through the service but does not erase files or copies that an authorized recipient has already obtained.

5. Your content and intellectual property

You retain the rights you hold in your models, sketches, imported files and other contributions. You must have the necessary rights to upload, modify and share them. Using Atelier does not transfer ownership of your projects to MAXKEN.

For the sole purpose of providing the features you use, you authorize MAXKEN to store, technically reproduce, process and display your content, and transmit it to recipients you authorize. This permission is non-exclusive and limited to operating the service for your content, including necessary technical backups for their retention period. It does not grant a general right to sell or commercially reuse your projects.

The interface, texts, visuals and software components are subject to the rights and licenses of their respective owners. Third-party and open-source components retain their own licenses.

6. Acceptable use

Use Atelier lawfully and respect other users’ intellectual property, privacy and confidentiality. Do not upload unlawful content or malicious files, impersonate someone else, access projects without authorization, or collect other users’ data without a lawful basis.

Do not bypass authentication, permissions or technical quotas, exploit a vulnerability, or deliberately overload or disrupt the service. Authorized automation must respect the access controls and limits of the interface it uses. Report suspected security issues or unlawful content to MAXKEN, with enough information for us to examine the report.

7. Design checks and responsibilities

Atelier is a design tool. A displayed measurement, analysis, drawing or export does not by itself certify a part, its strength, tolerances or fitness for a particular use. Check units, geometry, dimensions, materials and manufacturing parameters before producing or using an object. Arrange appropriate professional checks where your project requires them.

The beta can contain errors, unsupported operations or import and export differences. The documentation describes known limits. Report reproducible problems to MAXKEN and keep a copy of the affected project where appropriate.

Each party remains responsible for its obligations under applicable law. These terms do not exclude or reduce any mandatory consumer rights, applicable statutory guarantees, or compensation rights that cannot lawfully be limited. The beta status and the precautions above do not release MAXKEN from those obligations.

8. Availability and service changes

MAXKEN maintains and improves Atelier. Maintenance, security work, technical incidents or network problems can temporarily interrupt access or some features. We seek to limit disruption and give advance notice of planned significant interruptions when reasonably possible.

Features can evolve with updates, particularly during the beta. Significant changes affecting your use will be explained in an appropriate way. A substantial reduction or discontinuation of an online feature will be announced with reasonable notice and an opportunity to export projects where possible, except where urgency or a legal requirement prevents it. Mandatory legal rights continue to apply.

9. Suspension and ending use

You can stop using Atelier at any time, export or delete projects according to your permissions, and contact MAXKEN to request account deletion. Before deletion, consider the effect on shared projects and keep any files you need. Personal data and backup retention are explained in the privacy policy.

MAXKEN may restrict access where reasonably necessary to address a material breach of these rules, unlawful use, a security threat or a binding legal requirement. Measures must be proportionate. Unless urgency or the law prevents it, the affected user will be informed of the reasons and given an opportunity to remedy the issue or challenge the measure by contacting MAXKEN.

Suspension does not itself transfer ownership of your content to MAXKEN. Where lawful and technically possible, we will provide a reasonable way to retrieve your projects before permanent account closure. Information may be retained where required by law or necessary to handle a dispute.

10. Personal data

The privacy policy explains the data used for accounts, projects, collaboration, browser storage, security and analytics, the providers involved and your rights. It is available separately from these terms.

Acceptance of terms of use is not consent to advertising or to processing that legally requires separate consent. Where consent is required, it must be obtained separately and can be withdrawn under the conditions described in the privacy policy.

11. Changes to these terms

The date at the top identifies this version. MAXKEN may update these terms to reflect service developments or changes in the law. Significant changes will be brought to your attention before they take effect, with reasonable notice unless an urgent legal or security requirement prevents it.

Changes do not apply retroactively. Where your agreement is legally required, the new terms must be presented for acceptance. You can stop using the service and request account closure if you do not wish to continue under the new terms, without losing any rights you already have.

12. Applicable law and complaints

These terms are governed by French law, without depriving consumers of mandatory protections applicable in their country of habitual residence. No provision gives a court exclusive jurisdiction contrary to applicable legal rules.

For a question or complaint, contact MAXKEN using the contact button below and describe the issue. We will examine your request and seek an amicable resolution. This does not prevent you from using the remedies available under applicable law or bringing a matter before the legally competent courts.
